DriveSeniors Terms of Use
Effective November 1, 2026
Agreement and eligibility
These Terms of Use (“Terms”) govern the DriveSeniors website, directory, resources, and related communications (the “Services”). DriveSeniors means “we,” “us,” or “our.” By accepting these Terms, or using the Services with legally sufficient notice, you agree to them. Otherwise, do not use the Services. You must be at least 18, have reached the age of majority where you live, and be legally able to enter this agreement.
These Terms include binding individual arbitration and a class action waiver, subject to the exceptions below. They affect how disputes are resolved. You may opt out of arbitration within 30 days as explained in Disputes and individual arbitration.
What DriveSeniors provides
DriveSeniors is a self-guided directory for researching independent living, assisted living, memory care, and active adult communities by location, community type, and listed monthly price. Browsing is free and requires no account or contact details.
You choose which communities to contact. We do not operate communities, make reservations, arrange admissions, assess care needs, or guarantee placement. We are not your agent or a community’s agent and are not a party to your agreements with providers.
Listings and search results
Supplied listing information may be incomplete, outdated, or incorrect. DriveSeniors has not independently verified current licenses, operating status, services, staffing, or availability. Inclusion does not establish a partnership, endorsement, inspection result, award, or recommendation.
Results reflect your filters and sorting choices, not quality rankings or clinical recommendations. Location searches do not calculate travel distance, and the directory may not include every provider. Confirm important information with the community and relevant licensing authority.
Pricing information
Reported monthly prices are not binding quotes. Starting prices and budget filters use the lowest listed amount; ranges may reflect multiple reports for a room type. These amounts may not apply to your accommodation or care needs.
Rates may lack an effective date, change, or exclude care charges, deposits, and other fees. Pricing not provided means a usable rate is unavailable or unclear, not that a community is unavailable or unaffordable. Obtain a current written quote and review the provider’s agreement before committing.
Your decisions and professional advice
Each community is responsible for its admissions, licensing, staff, services, charges, and contracts. Evaluate providers independently and confirm whether they can meet your needs. Website content and communications are general information, not medical, legal, financial, insurance, or other professional advice. Consult qualified professionals for advice about your circumstances. For a medical emergency or immediate safety threat, call 911; do not rely on the website for emergency assistance.
Privacy and communications
Our Privacy Policy explains information practices and privacy choices. These Terms do not replace separate consent required for tracking, marketing, or sensitive information. Optional tracking remains off unless you accept it through the cookie controls. Reopen Cookie Preferences to change your choice.
Phone calls and text messages
When you provide your telephone number and request contact, you authorize DriveSeniors to call or text you about your inquiry and related senior living options. A community or other provider may contact you only if you separately authorize that contact. You represent that you are the subscriber or customary user of the number and have authority to provide it; tell us if it changes or is reassigned.
Marketing calls or texts using an automatic telephone dialing system or an artificial or prerecorded voice require prior express written consent where required by law. We obtain that consent through a separate, clear disclosure and affirmative action. Merely browsing the website or accepting these Terms does not provide that consent. A valid written or electronic authorization may permit the identified caller to contact you even if your number is on a federal or state Do Not Call registry, to the extent permitted by law.
Consent is not a condition of purchasing goods or services or browsing the directory. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of texts, tell us during a call, or email contactus@driveseniors.com. You may also use another reasonable method to revoke consent. We honor requests within applicable legal deadlines and may send a nonmarketing confirmation. For help, email the same address.
We do not share mobile numbers with third parties for their own marketing without specific authorization. Text messaging opt-in records and consent are not shared for third parties’ own marketing or promotional purposes. Providers supporting our communications may process those records to perform their services.
Telephone recording
If DriveSeniors records or monitors a telephone conversation, we will provide notice and obtain consent as required by applicable law. These Terms alone do not replace that notice or consent. Independently operated communities are responsible for their own recording practices and disclosures.
Permitted use and restrictions
We grant you a limited, nonexclusive, nontransferable permission to use the website for personal research or to help someone you are authorized to assist. You may save or print reasonable portions of listings for that purpose and share links to DriveSeniors pages. Keep ownership notices intact. This permission does not authorize commercial republication or resale of the directory.
You must not use the Services unlawfully; impersonate others; submit information without authority; introduce harmful code; disrupt the website; bypass security or access controls; harvest personal information; or scrape, bulk-copy, resell, or use site content to train artificial intelligence models without our written permission. Reverse engineering and other restrictions apply only to the extent allowed by law. Ordinary public search engine indexing is permitted subject to applicable access instructions.
Ownership and feedback
DriveSeniors or its licensors own the original website design, software, branding, and protected content. Community names and other third-party materials remain the property of their respective owners. These Terms do not claim exclusive ownership of public facts or imply that a third-party trademark owner sponsors DriveSeniors. Rights not expressly granted are reserved.
You may send corrections or suggestions to contactus@driveseniors.com. We may use your feedback to address the issue and improve the Services without compensation. This does not grant us a right to publicly use your name, likeness, private correspondence, or personal information contrary to the Privacy Policy.
Independent providers
Any dealings with a community or another independent provider are between you and that provider and are subject to its own terms and privacy practices. We do not guarantee a provider’s performance or resolve its admission, payment, refund, or care decisions. A listing does not make DriveSeniors responsible for a provider’s acts or omissions, except where applicable law provides otherwise.
Disclaimers
To the fullest extent permitted by law, the Services are provided as is and as available, without express or implied warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, or noninfringement.
We do not guarantee uninterrupted or error-free operation, freedom from harmful components, current prices or availability, or any particular outcome from using the directory. We may correct, update, or remove information. Nothing in these Terms excludes a warranty or protection that applicable law does not permit us to exclude.
Limits on liability
To the fullest extent permitted by applicable law, DriveSeniors and its officers, employees, and service providers are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of or inability to use the Services. Their aggregate liability for claims concerning the Services will not exceed the greater of $50 or the amount you paid DriveSeniors for access to the Services.
These limits apply only where lawful. They do not exclude or restrict liability for fraud, willful misconduct, gross negligence, or other liability or remedies that cannot lawfully be limited. Mandatory consumer protections remain available. Nothing requires you to waive a nonwaivable legal right.
Responsibility for misuse
To the extent permitted by law, you agree to indemnify DriveSeniors and its officers and employees against third-party claims and reasonable costs arising from your unlawful use, material violation of these Terms, or infringement of another person’s rights. This obligation does not cover loss caused by DriveSeniors’ own negligence or misconduct or impose costs prohibited by consumer protection law. We will provide notice of a covered claim and a reasonable opportunity to participate in its defense.
Availability and changes
We may modify or discontinue features and suspend access for misuse, security, maintenance, or legal reasons. Continued availability is not promised. Ownership, liability, and dispute provisions survive termination where lawful.
We may revise these Terms and update the effective date, providing notice or obtaining acceptance as required. Changes apply prospectively and do not alter an existing dispute without agreement. Continued use constitutes acceptance only after legally sufficient notice and an opportunity to stop using the Services.
Disputes and individual arbitration
Except as stated below, you and DriveSeniors agree that disputes arising out of these Terms or the Services will be resolved by binding individual arbitration administered by JAMS under its applicable arbitration rules and Consumer Minimum Standards of Procedural Fairness. The Federal Arbitration Act governs the arbitration agreement to the extent applicable. You may request copies of the applicable rules by emailing contactus@driveseniors.com.
For disputes subject to arbitration, both parties waive a court trial and jury trial and agree to proceed individually, without a class, collective, or representative action, to the extent permitted by law.
Exceptions and remedies. Either party may bring an eligible claim in small claims court or seek temporary court relief to protect intellectual property pending arbitration. Claims or remedies that cannot lawfully be required to proceed in arbitration remain available in a court with proper jurisdiction. This includes public injunctive relief where the law requires access to that remedy. The arbitrator may award relief available under applicable law for an individual claim.
Process and costs. The parties will have a reasonable opportunity to select a neutral arbitrator and exchange relevant nonprivileged information. The arbitrator will issue a written decision with essential findings. You may request an in-person hearing in your home area; the location must not prevent access to arbitration. If you initiate a consumer arbitration, your required JAMS fee will not exceed $250, and DriveSeniors will pay the remaining JAMS and arbitrator fees. If DriveSeniors initiates it, we pay those fees. Any lower consumer fee or additional protection required by law or JAMS applies. Attorney fees may be awarded only as permitted by applicable law.
Thirty day opt out. You may opt out of arbitration and the class action waiver by emailing contactus@driveseniors.com within 30 days after first accepting these Terms. Use the subject Arbitration Opt Out and include your full name, mailing address, the email address you use to contact us, and a clear statement that you opt out. Opting out does not affect your ability to use the Services or the other Terms.
Severability and court claims. If a part of this arbitration agreement is unenforceable, the remainder continues where lawful. If the class action waiver cannot be enforced for a particular claim or remedy, that claim or remedy proceeds in court rather than class arbitration. Any matter properly brought in court must be filed in a court with lawful jurisdiction and venue.
Applicable law and general terms
Applicable United States federal and state law governs these Terms, including mandatory consumer protections. The law governing a particular dispute is determined under applicable choice-of-law rules, subject to the arbitration provision above. These Terms do not require an exclusive court location in a particular state.
These Terms are the agreement concerning use of the Services, subject to any separate agreement we expressly enter with you. They do not replace the Privacy Policy or separately obtained consents. If a provision is unenforceable, the remaining provisions continue where lawful, subject to the arbitration rules above. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our written permission.
Copyright concerns and contact
To report suspected copyright infringement, email contactus@driveseniors.com with the subject Copyright Concern. Identify the work, the material on DriveSeniors you believe infringes it, and its location. Include your contact information and signature, a statement that you believe the use is unauthorized, and a statement that the information is accurate and, under penalty of perjury, you are authorized to act for the rights holder. We may request further information to assess the concern.
